This document is an electronic record in terms of the Information Technology Act, 2000 and rules there under pertaining to electronic records as applicable and amended. This electronic record is generated by a computer system and does not require any physical or digital signatures.

Please ensure to read the following Terms and Conditions very carefully before using this website, accessing, browsing or otherwise using the website implies your agreement acceptance to be bound by all this Terms and Conditions (Service Agreement). PehliMulakat.com is a platform providing targeted advertising services for matchmaking alliances and replacing the traditional newspaper classifieds. The Site is for the personal use of individual members to advertise and promote their profiles for the purpose of finding relevant matche and cannot be used in connection with any commercial endeavour�s.

NOTE: The Site is a serious Matchmaking platform to seek a Life Partner and is strictly not a casual dating site.

Access to the PehliMulakat.com website is free. However, we offer Premium Memberships wherein one can promote his/her Profile on PehliMulakat.com

1. Eligibility:
To register as a member of PehliMulakat.com or use this Site, you must be legally competent and of legal marriageable age as per the laws of India (currently), 18 years or over for female and 21 years or over for male).
The PehliMulakat.com site is only to facilitate personal advertisement for lawful marriage alliance between persons who are legally competent to enter into matrimony under the laws to which they are subject. Membership in the Service is void where prohibited.
By using this Site, you represent and warrant that you have the right, consent, authority, and legal capacity to enter into this Agreement; submit relevant information to us; and that you are not prohibited or prevented by any applicable law for the time being in force or any order or decree or injunction from any court, tribunal or any such competent authority restraining you from entering into matrimony.
You further confirm that you, intent to seek a Life Partner and that you shall not use this site for casual dating. You also agree to abide by all of the terms and conditions of this Agreement. If at any time PehliMulakat.com is of the opinion (in its sole discretion) or has any reason to believe that you are not eligible to become a member or that you have made any misrepresentation, PehliMulakat.com reserves the right to forthwith terminate your membership and / or your right to use the Service without any refund to you of any of your unutilized subscription fee.

2. Security (Account):
You are responsible for safeguarding the confidentiality of your PehliMulakat.com login credentials you create/designated during the registration process, as your user id, password, OTP, etc., and you are solely responsible for all activities that occur under your account. You agree to immediately notify us of any disclosure or unauthorized use of your account or any other breach of security, and ensure that you log out from your account at the end of each session.

3. Registration:
a. PehliMulakat.com expects that you would complete the online registration process with fairness and honesty in furnishing true, accurate, current, complete information and with providing recent photos of you which will help you to meet your parameters . We expect you to read the relevant column before keying in the details or selecting the option available or uploading the photographs. You are requested not to key in details of the profile in field other than the applicable field (including mentioning id's of other platforms/websites/App or repeating your details in another fields, after filling them once in the relevant fields or others photographs. In order to serve you better if PheliMulakat.com requires additional details you agree to provide it. You may also give a call on our phone number for us to assist you in getting your profile registered on our website. Further you may fill in your email id and phone number in any of our registration campaigns appearing in various websites as part of our advertisements, basis which you may receive call from our Customer Service Centre and assist you in getting your profile registered on our website. PehliMulakat.com may also reproduce your profile information in other matrimonial websites owned by PehliMulakat.com including community based websites to provide better matching Profiles to you.

b. If at any point of time PehliMulakat.com comes to know or is so informed by third party or has reasons to believe that any information provided by you for registration (including photos) or otherwise is found to be untrue, inaccurate, or incomplete shall have full right to suspend or terminate (without any notice) your PehliMulakat.com membership and forfeit any amount paid by you towards PehliMulakat.com membership fee and refuse to provide PehliMulakat.com service to you thereafter.You further confirm that you, intent to seek a Life Partner and that you shall not use this site for casual dating. You also agree to abide by all of the terms and conditions of this Agreement. If at any time PehliMulakat.com is of the opinion (in its sole discretion) or has any reason to believe that you are not eligible to become a member or that you have made any misrepresentation, PehliMulakat.com reserves the right to forthwith terminate your membership and / or your right to use the Service without any refund to you of any of your unutilized subscription fee.
c. PehliMulakat.com also reserves the right to block the registration of your profile on Website, if any, in the case of your contact details/links being entered in irrelevant fields or if there are errors in any data entered by the PehliMulakat.com members in their profile.
d. Registration of duplicate profiles of the same person is not allowed in PehliMulakat.com Website. PehliMulakat.com shall have full right to suspend or terminate (without any notice) such duplicate profiles.
e. You acknowledge and confirm that your registration with PehliMulakat.com and the usage of PehliMulakat.com services is with the bonafide intention of marriage and not otherwise. PehliMulakat.com Membership is restricted strictly to the registered PehliMulakat.com individual member only. Organizations, companies, businesses and/or individuals carrying on similar or competitive business cannot become Members of PehliMulakat.com and nor use the PehliMulakat.com Services or PehliMulakat.com members data for any commercial/marketing purpose, and PehliMulakat.com reserves its right to initiate appropriate legal action for breach of either of these obligations. Illegal and/or unauthorized uses of the Site, including unauthorized framing of or linking to the Site will be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal, and injunctive redress.

4. Our (PehliMulakat.com) Responsibility and Role:
PehliMulakat.com reproduces your details once you register on our website on "as is as available" basis and also share your profile with other registered PehliMulakat.com members within website(s).
PehliMulakat.com does not prohibit/stop any member from sending interest to your profile or communicating to you based on their partner preference. But you are at the liberty to deny/accept their interest or proceed further if you are interested.
PehliMulakat.com cannot guarantee the complete protection of user data while it is in transit, or prevent any tampering of the data by a third party with malicious intent before the data reaches the PehliMulakat.com servers.
PehliMulakat.com obligation is only to provide an interface to our registered members to search for their prospect themselves without any assistance.
The profile search conducted by any PehliMulakat.com member and the matches shown thereof are automatically generated by PehliMulakat.com, and based on the partner preference set by you. In the event of, PehliMulakat.com member changing their partner preferences on the Website, then the automated system generated prospect results of the Website may also undergo corresponding changes.
PehliMulakat.com do not authenticate/endorse any information of any profile and hence you as a user need to verify the credentials and information provided by other users.
PehliMulakat.com shall safeguard sensitive user information using security standards, authentication mechanisms, access controls and encryption techniques.

5. PehliMulakat.com Member Responsibility:

You, shall safeguard your profile/account information by creating a strong password during profile creation with combination of alphabets, upper and lower case alphabets and numbers.
You are requested to verify the credentials of the prospect, exercise due care and caution regarding their profile information which includes marital status, educational qualifications, financial status, occupation, character, health status, horoscope etc. and satisfy yourself before making a choice of your perfect match. PehliMulakat.com shall not be liable for short coming due to any misrepresentations made by any of its PehliMulakat.com members.
You are required to verify the credentials of the prospect and we shall not be liable for any misbehaviour/ misrepresentations made by the Prospect to you during video/audio call.
Any information / details / data required by PehliMulakat.com for using the PehliMulakat.com services shall be provided by the PehliMulakat.com Members, as and when so sought by PehliMulakat.com.
To get better search results, PehliMulakat.com Members are expected to provide latest photographs which should not be more than 2 (Two) months old. Providing old photographs/ photographs of others, inaccurate / false information shall be treated as violation of terms and conditions and PehliMulakat.com shall retain their right under clause 3 (b) of this terms and conditions.
PehliMulakat.com members are expected to disclose about their health records during profile registrations which includes any pre-existing illness, physical disability etc. Non - disclosure at the time of registration shall be treated as violation of the terms and conditions and PehliMulakat.com shall retain their right under clause 3 (b) of this terms and conditions.
PehliMulakat.com Members are advised to refrain from: a. Entering into any financial transactions with prospects. PehliMulakat.com Members shall not seek financial help or provide financial help from / to the other PehliMulakat.com Members.
b. Using abusive language when they communicate with the other PehliMulakat.com Members.
c. Being discriminative or using racial comments etc.
d. Sharing of confidential and personal data with each other but not limited to sharing of bank details, etc.
e. Entering into physical relationship with any prospect before marriage.
f. Violating any law for the time being in force.
g. From mentioning details of other matrimonial services while sending personalized messages.
PehliMulakat.com Members are expected to be cautious of prospects who ask for favours, money etc or call from multiple phone numbers, only interact over phone, doesn't come forward for face-to-face meeting (physically or through video calls) and don�t involve family and friends in match making. Beware of suspended profiles status before you finalize an alliance with the prospect.
PehliMulakat.com members agrees that for getting effective search results of prospects on Website you will regularly log in to the profile maintained in the Website and send expression of interest which is an automated message to prospects as a free PehliMulakat.com member, and in the event, you have availed paid PehliMulakat.com membership, you can send personalized messages to prospects to show your expression of interest/replies. PehliMulakat.com member also may review the expression of interest sent to you / read the messages sent to you by prospects and may respond suitably.
You also agree that while accessing / using the Website, you will be guided by the terms and conditions of the Website including but not limited to the use of feature of website, like chat instantly with prospect, viewing horoscope of prospects, enhancing privacy settings (photo/horoscope/phone number) or for viewing social and professional profile of members on their Facebook, Instagram, LinkedIn, etc.
If the PehliMulakat.com Member fails to update in PehliMulakat.com website, any change in the particulars furnished in their profile/ then the PehliMulakat.com membership may be suspended by PehliMulakat.com at its sole discretion.
PehliMulakat.com member shall, in case of finalization of his/her/their Registrant�s marriage, delete their profile by themselves or intimate PehliMulakat.com for removal/deletion of their profile.
PehliMulakat.com Members agree to use secure devices, software and networks in a private place for accessing their profile/account for PehliMulakat.com services.
PehliMulakat.com member shall not use any kind of Bots like web robots, Chatbot or any other automated processes/programs/scripts to use, communicate or respond in PehliMulakat.com Website.
PehliMulakat.com Members shall not probe, scan or test the vulnerabilities of the PehliMulakat.com website or any network connected to the website, nor breach the security measures instituted by PehliMulakat.com.
You shall also not make any payment / transfer any amount to account of any PehliMulakat.com employees. All payments shall be made only to PehliMulakat.com account.
PehliMulakat.com members are expected to approach PehliMulakat.com to resolve their complaints and grievances and shall not air their grievances/complaints in social media.

6. Confidentiality:
Any feedback you provide to PehliMulakat.com shall be deemed to be non-confidential. PehliMulakat.com shall be free to use such feedback/information/details on an unrestricted basis. Further, by submitting your feedback, you represent and warrant that:
(i) Your feedback does not contain confidential or proprietary information of yourself or third parties;
(ii) PehliMulakat.com member is not under any obligation of confidentiality, express or implied, with respect to the feedback;
(iii) You are not entitled to any compensation or reimbursement of any kind from PehliMulakat.com for the feedback under any circumstances.

7. Privacy of Membership at PehliMulakat.com:
To protect your privacy and understand our practices as amended from time to time , please read and follow our Privacy Policy which also governs your visit to PehliMulakat.com, the personal information / data provided to us by you during the course of usage of PehliMulakat.com will be treated as confidential and in accordance with the Privacy policy and applicable laws and regulations. If you object to your information being transferred or used, please do not use the website.

8. Communication to PehliMulakat.com Members:
PehliMulakat.com members do hereby consents for receiving communication including promotional communications through any medium of communications such as electronic mails, calls, SMS or through WhatsApp messages from PehliMulakat.com or other portals owned by PehliMulakat.com.
PehliMulakat.com by its automatic system sends to its member (s) profile (s) of the prospect by way of images/ documents/ messages / links. PehliMulakat.com member confirms that the mobile number submitted to it for verification or alternative number if any provided, is not registered with the Do Not Disturb / National Customer Preference Register and they shall not initiate any complaint.
PehliMulakat.com member further confirms that even if PehliMulakat.com Member is registered with the telecom service provider under the category Do Not Disturb / National Customer Preference Register the calls from PehliMulakat.com either to the verified mobile number or alternative number if any provided shall not be treated as promotional calls.
You are also allowed to set up your communications frequency from PehliMulakat.com, like - only on weekends or fortnightly etc. You may also opt for not getting any calls from PehliMulakat.com by ticking the appropriate box in the Website, provided that, you agree to receive calls from Relationship Manager for contacting you as a shortlisted profile for their registered members.

9. Member Disputes:

PehliMulakat.com Members are solely responsible for the communications (through any medium) with prospect or vice versa. PehliMulakat.com expressly disclaims any responsibility or liability for any monetary transaction(s) or exchange(s) or interaction(s) or passing of information(s) etc. between any PehliMulakat.com members inter se via e-mail, chat, interaction, WhatsApp or any other medium of communication between PehliMulakat.com members either using website or otherwise.
PehliMulakat.com has no obligation, to monitor any such disputes arising between the PehliMulakat.com members, and PehliMulakat.com shall not be party to any such dispute/litigation etc.
PehliMulakat.com is not a broker or the agent of any PehliMulakat.com member, and PehliMulakat.com does not partake in the exchange of any kind of discussion between the PehliMulakat.com members and prospects or the results of their discussion.

10. Limitation of liability:

PehliMulakat.com or its Office bearers shall under no circumstances be liable or responsible to the PehliMulakat.com member or his/her authorized Representative or Registrant or any third party for any direct, indirect, special, exemplary, incidental, or consequential damages of any character including, without limitation, damages resulting from the use of our Website/App/Third Party Website/ PehliMulakat.com services.
PehliMulakat.com informs you that the exchange of profile(s) through or by PehliMulakat.com should not in any way be construed as a matrimonial offer and/or recommendation and / or advice or guarantee given to the PehliMulakat.com member, from/ or by PehliMulakat.com.
Notwithstanding anything to the contrary contained herein, PehliMulakat.com�s liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to PehliMulakat.com, for any specific PehliMulakat.com paid package, and no further.
PehliMulakat.com will not be liable in case of any wrong/improper match made due to unavailability of profiles from PehliMulakat.com owned other websites.
PehliMulakat.com or our office bearers shall under no circumstances be liable/responsible, if any, for the PehliMulakat.com members entering into financial transaction with any other PehliMulakat.com Members or any third party.
PehliMulakat.com or our office bearers shall under no circumstances be responsible, if any, for any PehliMulakat.com members not responding/reciprocating/replying when you approach them for matrimonial alliance.
In the event you file a false complaint against another prospect on our Website and consequently we have suspended/deleted that prospects profile based on your complaint, then we reserve our right to initiate appropriate legal (Civil/Criminal) action against you and claim any and all costs expenses from you, for such irresponsible/misrepresentation/illegal/unlawful action. We also reserve our right to suspend your profile and forfeit any and all amounts paid by you for the PehliMulakat.com services as per clause 3 (b) of these terms and conditions.
Once your paid membership expires, you cannot avail the unexpired balance phone call count/ unexpired SMS. Similarly, you cannot access the already viewed PehliMulakat.com member(s) contact information unless you renew your account within 45 days. However, on renewal, the unexpired phone call / SMS shall be carried forward to your account from the last day of expiry.
In case of conflict between the terms and condition of Website and terms and conditions of any other website including other websites of PehliMulakat.com, the terms and condition of PehliMulakat.com Website shall prevail for the service provided through this Website.
By using our PehliMulakat.com services, you agree to defend, indemnify, and hold harmless PehliMulakat.com, its subsidiaries, affiliates, Directors, officers, agents, and other partners and employees, fully indemnified and harmless from any loss, damage, liability, claim, or demand, including reasonable attorney's fees, made by any person through improper use of the service provided by PehliMulakat.com. This defence and indemnification obligation will survive in perpetuity.

11. Renewals and Refunds:

The payments made by any PehliMulakat.com member to PehliMulakat.com by way of membership / renewal fee / auto renewal are treated as non-refundable. Shipping and Return, Refunds are Not Applicable. For Cancellation, If you do not want your paid membership to automatically renew, you must cancel your paid membership. You have to mail for cancellation, mail to helpdesk@pehlimulakat.com. Our team will Cancel your membership within 48 Hours of Cancellation email. For Cancellation: Write to helpdesk@pehlimulakat.com. Payment once made for PehliMulakat.com services cannot be assigned to any person/party/member or adjusted towards any other product or packages provided by the PehliMulakat.com.
PehliMulakat.com member shall not assign or transfer your PehliMulakat.com membership to any other person or entity, and such an act shall be treated as violation of terms and conditions and PehliMulakat.com shall retain their right under clause 3 (b) of this terms and conditions.
We automatically renew all paid Memberships before the expiry of the term of the paid Membership. You agree that your account will be subject to this automatic renewal feature. If you do not want your paid membership to automatically renew, you must cancel your paid membership. In case you have to mail for cancellation, mail to helpdesk@pehlimulakat.com
When you first subscribe for your paid Membership, you acknowledge that when your paid Membership expires, it will automatically renew for the duration and at the last paid price. The maximum tenure of any packages will be 12 (Twelve) Months. Every PehliMulakat.com packages post validity period (varies from package to package), shall be renewed.

12. Additional Terms and Conditions (Applicable to Non-Resident Indian Members)

The laws of India shall be applicable.
The Parties shall discuss among themselves and resolve any disputes informally. We are interested in attempting to resolve any Disputes by amicable and informal means, and we encourage you to contact us before resorting to arbitration. If the dispute is not resolved within 30 (Thirty) days from the date of such dispute, then such dispute may only be resolved through an individual arbitration conducted in accordance with the provisions of The Arbitration and Conciliation Act, 1996, by sole arbitrator. The seat of Arbitration shall be Panaji, Goa, India. We shall appoint the sole arbitrator. The arbitration proceedings shall be conducted in the English language. However, Disputes relating to infringement of our intellectual property rights, which we may elect to have resolved by means other than arbitration.
Any proceeding to enforce this arbitration agreement may be brought in Courts of Goa, India.

13. Packages:

We have multiple premium membership packages called Bronze, Gold, Diamond.
You can opt for any of our premium membership packages varying between three months to one year with different price to access various premium features.

3. Notwithstanding anything contrary contained anywhere, under no circumstances, PehliMulakat.com shall be held responsible or liable whatsoever or howsoever, arising out of, relating to or connected with:

b) Any untrue or incorrect information submitted by you or on your behalf;
c) Any decision taken by you or on your behalf or any consequences thereof, based on any information provided by any other user (including suspension/deletion of the profile from PehliMulakat.com);
d) Any unauthorized or illegal act done by any third party relating to or connected with any information submitted by you or on your behalf;
e) Any cyber-crime attempted or committed by anyone and
f) Any incident of force-majeure or 'act of god'.
g) Any issue already stated in these terms and conditions including limitation of liability clause of these terms and conditions.
h) Using/availing of third-party services namely horoscope matching, wedding planner�s services etc. and for paying them through the Website.
i) PehliMulakat.com shall not be liable for the outcome of during any interaction in a meeting, call, SMS, chat, email or social media posts at any point of time
j) Any issues relating to any technical malfunction of any telecommunication network, software, hardware failures, network congestion, denial of service, failure due to spamming or any combination of the above.
k) You expressly agree that your use of this Website is at your sole risk.
l) We are not liable to you for any damage or alteration to your equipment�s including but not limited to computer equipment�s, hand-held devices or mobile telephones.
